Abstract

This work aims to analyze the application of Law 11.340/2006, known as the Maria da Penha Law, and evaluate its effectiveness in confronting domestic violence against women in Brazil. The research seeks to identify the main institutional, cultural and social barriers that hinder the full execution of the legislation and propose ways to improve the protection system for women. To achieve these objectives, a bibliographic review of doctrinal works, academic articles and institutional reports was carried out, focusing on the analysis of concrete cases and the evaluation of statistical data on gender violence in the country. The methodology used was the literature review, from which the protective measures provided for in the law and how they are implemented in the daily lives of the victims were examined. The study observed theoretical data, seeking to identify possible failures in the justice system and in public policies aimed at the protection of women. The results pointed out that, although the Maria da Penha Law has provided important advances in the protection of victims, its application is still limited by factors such as lack of infrastructure, cultural resistance and institutional deficiencies. The research confirmed the hypothesis that there is a gap between the legislation and its practical effectiveness, highlighting the need for improvements in the state apparatus and social awareness to overcome these challenges and ensure greater protection for women victims of violence.
