Abstract

This Scientific Article proposes to carry out a legislative and doctrinal study on the importance of simplifying the legal terms mainly used in Brazilian Law, so that the lay population effectively participates in the creation of an inclusive and democratic State, since it is Through language, whether written or spoken, we achieve the much-desired justice. Bearing in mind that, packed with archaic expressions, elements of style and foreign words, “legalese” cannot be a mechanism for population segregation, but rather fulfills its function of regulating and instructing a society. Listing throughout the text the obstacles currently encountered that make it impossible to effectively propagate a clear and comprehensive language to all individuals; such as the lack of dissemination of legal writing in basic education institutions. And finally visualizing methods to alleviate, or even eradicate, the obstacles that prevent the full understanding of the positive norm, which appears obsolete for part of the population for whom it is intended, replacing such expressions with a common everyday language, at the same time address a legal topic, but without necessarily having the technicality and professionalism that the language used in Law requires.
