Abstract

Virtual rape has emerged as a topic of great relevance in the era of digital society, bringing to light complex issues about sexual abuse committed through communication technologies. This study aims to analyze the crime in its attempted form, identifying its characteristics in the light of criminal doctrine, investigating its manifestations in the virtual environment, observing the circumstances that prevent the consummation of the crime, and analyzing one of the first cases of attempted virtual rape in Brazil. The research adopts a descriptive, qualitative approach through bibliographic, legislative, documentary research, and case analysis. The first case of attempted virtual rape in Brazil illustrates the legal and procedural challenges faced in this context. Although the Brazilian penal code does not specifically classify virtual rape, the existing articles encompass the behaviors committed in this medium. However, there are challenges in the interpretation and application of the law in the face of the complexities of the digital environment.
