TENDÊNCIAS E DESAFIOS NA IMPLEMENTAÇÃO DA NOVA LEI DE LICITAÇÕES NO BRASIL

Abstract

Until April 1, 2021, public procurement was regulated by Law No. 8,666/1993 (General Procurement Law), Law No. 10,520/2002 (Auction Law), and Law No. 12,462/2011 (Differentiated Procurement Regime Law). However, on this date, Law No. 14,133 came into effect, introducing various changes to the procurement process, such as new principles, types of contracting, and evaluation criteria, in addition to altering the procurement phases, among other changes. This paper studies the challenges faced in implementing this legislative modernization and the way it was introduced into the Brazilian legal framework, as well as the changes and how they will affect procurement processes in the next years. The discussion is of great importance for the proper application of the bidding process, as its poor execution will result in losses for the public authority over the years.
