Abstract

This article aims to characterize the challenges and prospects for the resocialization of expenitentiaries in Brazil. From a bibliographical review, it is possible to see that the legislation implies the State's commitment not only to punish, but also to reinsert, post-penalty, the individual into society. Furthermore, the work addresses the nuances of the “temporary release” institute, which, as it has been revoked, may be responsible for the escalation of crime, in addition to which, combined with prejudice and the lack of efficient public policies, make the reintegration of inmates difficult. Furthermore, the study investigates how the lack of adequate support, during the process of executing the sentence, contributes to criminal recidivism, aiming to focus on the flaws found in the resocialization process, proposing alternatives capable of expanding the possibilities of reintegration of those convicted, and reduce rates of marginalization and recidivism.
