Abstract

The study addresses the challenges faced by transgender individuals in the prison system and examines whether there are, in fact, violations of their rights. It will discuss the rights already recognized for the transgender population during sentencing in prison facilities and how these rights are being applied, assessing their effectiveness in promoting rehabilitation. Additionally, necessary changes to address issues such as discrimination, homophobia, and transphobia within the prison system will be clarified, and the importance of a more effective legislative approach to ensure the humanization of rights in this context will be highlighted. In this context, transgender individuals are often targets of prejudice, which leads to psychological abuse, physical assaults, and sexual violence, resulting in irreparable harm. The analysis reveals that, although the state upholds rights and principles of human dignity, discriminatory practices remain frequent against minorities both within and outside the prison system, a central theme of this work. Thus, an urgent restructuring of prison policies is needed on social, political, and legal fronts to address these issues and enforce constitutional guarantees effectively.
