Abstract

The study in question aims to analyze resocialization and its importance in resolving the flaws in the country's public security system. The high rate of crime and criminal recidivism, linked to the precarious prison system, were the main topics discussed. Accordingly, the State's role as a guarantor of citizens' rights and the main public policies that guarantee jus puniend in an educational and humane way were investigated and how this can combat high crime rates. With an analysis of laws, jurisprudence and doctrines, it was important to highlight the validity of the Criminal Executions Law, which innovated the criminal execution system, encouraging resocialization and emphasizing the role of the State, not only as a guarantor of punishment but also as an agent of opportunities for the individual, after the period of imprisonment, guaranteeing the right to work, study, progression of regime, among other nuances beneficial to the inmate. Together, the former prisoner's difficulties in returning to society were highlighted, facing social prejudice and lack of professional and personal inclusion that make him return to crime.
